Welcome to Desert Paddleboards. These Terms of Service ("Terms") govern your use of desertpaddleboards.com and the experiences, classes, rentals, coaching, events and products we offer ("Services"). By using our website, booking, or making a purchase, you agree to these Terms. Please read them carefully — they include important information about risk, safety and liability.
The services we offer
Desert Paddleboards provides floating soundbaths, floating yoga and water-fitness classes, paddleboard rentals, guided adventures and retreats, life coaching, private and community events, and related products, across Arizona.
Bookings, payments and pricing
- Most experiences are booked and paid for online through FareHarbor, and shop purchases are processed through Stripe. Your use of those services is also subject to their own terms, presented at checkout.
- Some city-run classes (for example in Queen Creek, Sedona and Avondale) are booked and paid for through the relevant city's own registration system and are subject to that city's terms, pricing and policies, not ours.
- Prices are shown at the time of booking or purchase and may change for future dates. We aim to keep all information accurate but are not responsible for occasional errors.
Cancellations, rescheduling and refunds
- The cancellation and refund policy for each experience is shown at the time of booking and is managed through FareHarbor — please review it before you book.
- If you need to cancel or reschedule, contact us as early as possible and we will do our best to help, subject to that policy.
- City-run classes follow the cancellation and refund policy of the city you booked with.
- Memberships, where offered, are billed on a recurring basis and may be canceled at any time; we are generally unable to refund or provide make-ups for missed sessions.
- Occasionally an event may be rescheduled or canceled due to weather, venue issues or other circumstances beyond our control. In that case we will offer a reschedule or, where appropriate, a refund or credit.
Health, safety and assumption of risk
Our experiences take place on and around water and involve physical activity. You take part voluntarily and assume all risks associated with participation, including slips, falls, injury and — as with any water activity — drowning.
By booking or participating, you confirm that:
- you (and everyone in your party) are in good enough health to take part, and have considered any medical conditions, injuries or pregnancy with a doctor;
- you will follow all safety instructions from our team and the venue;
- you will not participate under the influence of alcohol or drugs; and
- you are responsible for supervising any minors in your care at all times.
A signed liability waiver may be required before you participate, in person or as part of your booking. These Terms do not replace that waiver. Non-swimmers and guests who prefer to stay dry are welcome at many of our events — please ask in advance.
Photography and media
We frequently photograph and record our experiences for our photo albums, marketing, website and social media. By attending, you grant Desert Paddleboards permission to use images and recordings that may include you, without compensation, for these purposes. If you would prefer not to appear, please tell our team at the event and we will do our best to accommodate you.
Equipment and rentals
- When you rent equipment from us, you are responsible for using it safely and returning it in the same condition, normal wear excepted.
- You are responsible for loss of, or damage to, rented equipment while it is in your care, and agree to follow all usage guidelines we provide.
Shop — products, shipping and downloads
- Physical products are shipped as described; shipping costs and estimated times are shown at checkout, and risk of loss passes to you on delivery.
- If a physical item arrives damaged or faulty, contact us promptly and we will make it right.
- Digital products (such as guides and music) are licensed for your personal, non-commercial use and may not be copied, redistributed or resold. As they are delivered instantly, digital purchases are generally non-refundable.
Wellness disclaimer
Our soundbaths, classes and related experiences are intended for relaxation and general wellbeing. They are not medical care and are not a substitute for professional medical, psychological or therapeutic advice or treatment. If you have a health concern, please consult a qualified professional.
Intellectual property
All content on this website — including text, photographs, audio, logos, the "Life is Better on the Water" branding and the site design — is owned by or licensed to Desert Paddleboards and may not be copied, reproduced or used without our written permission.
Third-party services and links
Our site links to and relies on third-party services (such as FareHarbor, Stripe, Google, Meta and city registration systems). We are not responsible for the content, availability or practices of those third parties.
Disclaimers and limitation of liability
- Our website and Services are provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law.
- To the fullest extent permitted by Arizona law, Desert Paddleboards and its owners, staff and contractors will not be liable for any indirect, incidental, special or consequential damages, or for any injury, loss or damage arising from your use of the website, participation in our activities, or use of our products — except where such liability cannot be excluded by law.
- Nothing in these Terms limits any liability that cannot lawfully be limited.
Indemnification
You agree to be responsible for, and to hold Desert Paddleboards harmless from, claims and costs arising out of your (or your party's) participation in our Services in breach of these Terms or of safety instructions.
Governing law
These Terms are governed by the laws of the State of Arizona, USA, and any dispute will be handled in the state or federal courts located in Arizona.
Changes to these Terms
We may update these Terms from time to time. The current version is always posted here with its "last updated" date; continuing to use our Services means you accept the updated Terms.
